What is a brain injury?

What is an anoxic brain injury?

There are different types of brain injuries, each one resulting from different traumas and/or incidents.

For example, an anoxic brain injury is the result of a complete lack of oxygen to the brain, which can lead to the death of brain cells. This can happen after approximately four minutes of oxygen deprivation.

What is a hypoxic brain injury?

A hypoxic brain injury is due to a restriction of oxygen being supplied to the brain, with the restricted air flow causing gradual death and impairment of brain cells.

In both of the above examples, this could happen if a person is injured, and they are delayed access to emergency lifesaving treatment.  This could include delayed paramedic care, or delays in A&E resulting in avoidable worsening of a person’s brain injury as a result of an extended period of restricted oxygen supply to the brain.

Brain injury claim time limit

The standard time limit for making a brain injury claim is three years from the date of the injury. This is referred to as the limitation date. It’s important that you start proceedings as soon as you realise you have suffered an injury.

In some cases, you may not know that the injury was the result of negligence, so the 3-year limit starts from the date you first knew, or ought to have known, that your problems may be linked to negligent care. You should always consult with a legal professional to make sure you know exactly what your rights are, and the best next steps to take for your specific case.
